These Terms of Service (“Terms”) govern your use of the services provided by Serverfellows, a brand of BHATIA LABS INC (“Serverfellows”, “we”, “us”, or “our”). By signing up for, accessing, or using any of our hosting, domain, email, SSL, or related services (the “Services”), you (“Customer”, “Client”, or “you”) agree to be bound by these Terms.

Please read this agreement patiently and carefully. It represents the complete agreement between Serverfellows and the account holder and supersedes any prior written or oral agreement. Upon notice published online, Serverfellows may modify these Terms, amplify them, modify the prices, or discontinue or change services offered.

1. Account Setup

We will set up your account after we have received payment and our payment partners have screened the order for fraud. It is your responsibility to provide us with a contact email address that is not at the domain you are signing up under. For payments made through PayPal or credit card, accounts are typically activated instantly.

2. Acceptable Use & Content

No Service provided by Serverfellows may be used for unlawful or unacceptable purposes. Examples of unacceptable material include, but are not limited to:

• IRC bots and unattended automated processes that disrupt other users.
• Content that violates the laws of the United Arab Emirates, India, or the country in which the server is hosted (directly or indirectly).
• Pirated software or media.
• Hate sites, racism, or content that incites violence.
• Hacking programs, exploit archives, or distribution of malware.
• Pornography of any kind.
• Trade secrets or copyrighted material used without authorisation.
• Illegal goods, controlled substances, and related content.

3. Zero-Tolerance Spam Policy

We take a zero-tolerance stance against the sending of unsolicited email, bulk emailing, and spam. “Safe lists” and “double opt-in” lists obtained from third parties will be treated as spam. Any user who sends out spam will have their account terminated without notice.

We reserve the right to require changes or to disable any website, account, database, or other component that does not comply with this policy, at our sole discretion.

3.1 Clean-up Fee. We reserve the right to charge the holder of an account used to send unsolicited email a clean-up fee to cover the cost of investigation and remediation.

3.2 IP Protection. We take active measures to prevent abuse of our network and to protect our IP space from blacklisting.

4. Payment Information

You agree to supply appropriate payment for the Services in advance of the period during which such Services are provided. Until you notify Serverfellows in writing of your desire to cancel any or all Services, those Services will be billed on a recurring basis. We reserve the right to change the recurring amount and any other charges at any time, with reasonable notice.

4.1 Payment methods. We accept secure credit-card payments and offline methods for clients in supported regions. International clients may pay by PayPal, credit card, or bank wire transfer.

4.2 Renewals & suspensions. You will receive email reminders before the end of your billing cycle. If a Service is unpaid past its expiry date, it will be automatically suspended. If the Service remains unpaid for 60 days, the account will be deleted and all data may be permanently lost.

5. Backups and Data Loss

Use of the Service is at your sole risk. We are not responsible for the files and data residing on your account. You agree to take full responsibility for files and data transferred to our servers and to maintain appropriate independent backups.

5.1 We perform data backups of all accounts on a weekly basis as a courtesy. We are not responsible for damaged backups or for missing files, database corruption, or file corruption that occurs during the backup or restore process.

5.2 We strongly advise every customer to keep independent backups and copies of their websites and data.

6. Cancellation and Refunds

We reserve the right to cancel an account at any time if the site is found to violate any of these Terms. A client may cancel their account at any time, but a refund can only be obtained within the first 30 days of the service subscription. No refund is available for domain-name registrations, renewals, or SSL certificate purchases once the registry/issuer has been paid.

7. Resource Usage (applicable for shared-hosting clients only)

Users may not: use 25% or more of system resources for longer than 90 seconds; run stand-alone unattended server-side processes; or run any software that interfaces with IRC networks. We may suspend processes that breach these limits without notice.

8. Communications

As a customer, your email address will be added to our service mailing list. Only service announcements, security notices, billing reminders, and product updates will be sent. Marketing communications are sent only after a separate opt-in, and you can unsubscribe at any time.

9. Indemnification

You agree to defend, indemnify, and hold Serverfellows, its officers, employees, and affiliates harmless from any and all demands, liabilities, losses, costs, and claims arising from your use of the Services, including claims by third parties based on content you host.

10. Disclaimer of Warranties & Limitation of Liability

The Services are provided on an “as is” and “as available” basis. We make no warranties of any kind, express or implied. To the maximum extent permitted by law, Serverfellows shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity arising from your use of the Services. Our total aggregate liability shall not exceed the amount you paid us for the Services in the three (3) months preceding the event giving rise to the claim.

11. Domain Registrations

By registering a domain through Serverfellows, you also agree to the terms of the relevant registry and to ICANN's Registrants’ Rights and Responsibilities. WHOIS data is submitted to the registry as required and may be made public unless WHOIS privacy is supported and enabled. Refunds are not available once a domain has been registered or renewed.

12. Governing Law

These Terms are governed by and construed in accordance with the laws applicable to the place of business of BHATIA LABS INC. Any disputes shall be resolved exclusively in the competent courts of that jurisdiction, unless prohibited by applicable consumer-protection law.

13. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.

14. Changes to these Terms

We reserve the right to revise these Terms at any time. Material changes will be announced via email and/or a notice on this page at least 14 days before they take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms.
